BitRaider Terms of Service

1. Acceptance of Terms

Welcome to BitRaider! By accessing or using the BitRaider mobile application and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be located in a jurisdiction where cryptocurrency services are prohibited
• Not be on any U.S. or international sanctions list (OFAC, UN, EU)
• Successfully complete our Know Your Customer (KYC) verification process

3. Account Registration & Security

Account Creation

• You must provide accurate, current, and complete information
• You are responsible for safeguarding your account credentials and PIN
• You must notify us immediately of any unauthorized access

KYC/AML Compliance

As a financial service provider, we are required by law to verify your identity. You must provide government-issued photo ID, proof of address, and may be required to complete video verification.

4. Service Description

Cryptocurrency Transactions

BitRaider facilitates the purchase and management of cryptocurrency (primarily XRP):

• Purchases are processed through our partner exchange (Kraken)
• XRP is delivered to your non-custodial wallet within the app
• You own and control your private keys (encrypted on your device)
• Transactions are irreversible once confirmed on the XRP Ledger blockchain

Multi-Level Marketing (MLM) Structure

BitRaider operates a referral-based MLM compensation system:

• You must be invited by an existing agent to join as an agent
• Agents earn commissions on client transactions in their downline network
• Commission structure:
  • 5% Direct Agent Commission (paid to the agent who facilitated the transaction)
  • 5% MLM Pool Distribution (distributed to upline agents with reverse weighting)
  • 5% Platform Fee (retained by BitRaider for operations)
  • 85% Client Receives (net cryptocurrency amount delivered to client)

5. Financial Terms

Fees

• Transaction Fees: 15% total (5% agent, 5% platform, 5% MLM pool)
• Payment Processing: Credit/debit card fees determined by Stripe
• Exchange Fees: Kraken charges approximately 1% trading fee
• Network Fees: XRP Ledger transaction fees (typically <$0.01)

Refund Policy

6. User Responsibilities & Prohibited Activities

You agree NOT to:

• Use the Service for illegal activities (money laundering, fraud, terrorism financing)
• Provide false or misleading information
• Attempt to manipulate the MLM compensation structure
• Create multiple accounts to circumvent limitations
• Reverse engineer, decompile, or hack the Service
• Use automated bots or scripts
• Engage in pyramid scheme or Ponzi scheme behaviors

7. Cryptocurrency Risks

Volatility

• Cryptocurrency prices can be extremely volatile
• You may lose all or part of your investment
• Past performance does not guarantee future results

Regulatory Risk

• Cryptocurrency regulations are evolving and uncertain
• Future regulations may restrict or prohibit cryptocurrency use

Technology Risks

• Blockchain networks may experience outages or delays
• Wallet software may contain bugs or security flaws

Loss of Access

• If you lose your recovery phrase, you will permanently lose access to your funds
• We cannot recover your cryptocurrency if you lose your private keys
• Always back up your recovery phrase securely

Irreversibility

• Cryptocurrency transactions cannot be reversed or cancelled
• Sending to the wrong address results in permanent loss

8. MLM Compliance and Disclosures

No Guaranteed Income

Legitimate Product Sales

BitRaider operates as a legitimate cryptocurrency service provider, NOT a pyramid scheme:

• Revenue is primarily from cryptocurrency transaction fees, not recruitment
• Commissions are based on actual product sales (crypto transactions)
• No payment required solely for recruiting others
• You can earn money without recruiting (as a direct agent)

FTC Compliance

We comply with Federal Trade Commission (FTC) guidelines on MLM marketing:

• Earnings claims must be truthful and substantiated
• We prohibit misleading income representations
• We require clear disclosures of typical earnings

9. Intellectual Property

All content, features, and functionality of the Service are owned by BitRaider and protected by copyright, trademark, and other intellectual property laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless BitRaider from any claims, losses, damages, and expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution and Arbitration

Informal Resolution

Before filing a legal claim, you agree to contact us at legal@bitraider.app to attempt to resolve the dispute informally.

Binding Arbitration

14. Termination

We may suspend or terminate your account immediately if you violate these Terms, provide false information, or engage in suspicious activity.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use after changes indicates acceptance of the new Terms.

16. Regulatory Notices

Money Services Business (MSB)

BitRaider is registered with FinCEN as a Money Services Business (MSB) and complies with:

• Bank Secrecy Act (BSA)
• USA PATRIOT Act
• Know Your Customer (KYC) requirements
• Anti-Money Laundering (AML) requirements
